Criminal Background Check

1. It is up to the applicant to initiate one of the processes described below. The NCBDN does NOT initiate the background check process.

2. You should not begin one of the below (in-state or out-of-state) processes until you have registered in the licensee gateway AND submitted an application and payment for licensure or reinstatement.

PLEASE READ BEFORE CONTINUING

You can only use the "In-state/LiveScan" process if you are physically present in North Carolina (and your local fingerprinting agency in NC offers it). Do not use the below "In-state/LiveScan" process if you are physically in a state outside of North Carolina.

If physically outside NC (or your NC agency doesn't offer LiveScan) you MUST use the "Out-of-State Process" listed beneath the in-state process (please scroll down).

TIMING: Background Check timing is currently a minimum of 2-4 weeks from submission of fingerprints. We have no control over the processing time. 


IN-STATNC APPLICANTSLive Scan Instructions for Obtaining a Criminal Background Check (CBC):

*Use these in-state instructions ONLY if you are physically in the state of North Carolina and your chosen law enforcement agency offers LiveScan.

Step 1: After submission of a new or reinstatement application for licensure, your Licensee Gateway home page will have an icon in the top green menu bar, that says “CBC LiveScan.” Click on this icon to begin filling out the LiveScan application that will generate the forms that you will bring to law enforcement, and ultimately submit to our agency.

Step 2: After completing the CBC LiveScan online application noted in step 1, you will receive an email to the email address you have on file with us (check spam/junk if necessary.) Print and sign the attached forms found in the email you receive. The forms include the Electronic Fingerprint Submission Release of Information and Applicant Information Form. DO NOT UPLOAD THE UNSIGNED FORMS TO YOUR CHECKLIST. They are for you to bring with you to your LiveScan fingerprinting appointment. You will upload the signed release form AFTER you have your fingerprints taken, and the law enforcement agent signs and dates the release.

Step 3: Take both of your printed and signed Live Scan forms noted above to your Sheriff or Police Department, that you have verified offer Live Scan fingerprinting. Click here for a few resources we've compiled. (Note, you can only use the In-state LiveScan process in North Carolina – do not use this LiveScan process even if offered in a state outside of North Carolina. Also, do NOT let a private entity like the UPS Store send your prints "digitally"; if using a private entity instead of law enforcement, you need to follow the OUT OF STATE PROCESS and mail us the completed FD-258 cards.) These law enforcement personnel will obtain and transmit your fingerprints via Live Scan directly to the SBI (State Bureau of Investigations) and FBI (Federal Bureau of Investigations) and they must also have signed, dated, and checked the attestation on the Electronic Fingerprint Submission Release of Information form that you bring them. Important Note: If the law enforcement agency (LEA) does not see the NCBDN under their picklist on their Live Scan device they should be able to type it in manually; the NCBDN is listed as number 154. As long as the LEA taking the fingerprints includes the ORI# (aka OCA) on the card, which is NCBDN0000 for our board, the SBI/FBI should be able to process on their end. If problems finding the NCBDN persist, and the LEA needs assistance with this, please have them contact Cindy Coats at 919-582-8661.

Step 4: Scan/upload, email, fax, or mail your dually signed Electronic Fingerprint Submission Release of Information form, after Live Scan is complete. We will not be able to process your results without the signed form. 

Timing & Important Note: Results of your Background Check cannot be processed until the Electronic Fingerprint Submission Release of Information form is received by the Board office and you have paid all fees. Please plan on results taking 2 to 4 weeks from the time you have the fingerprints taken. The NCBDN office will NOT have any update on your application during this time as the process is in the hands of the SBI. Once results are received by our office, we will process them as expeditiously as possible and you will receive an email from the Gateway system when your application has been approved.


OUT-OF-STATE APPLICANTS: Hard copy/paper (FD-258 cards) Instructions for Obtaining a Criminal Background Check:

Step 1: If you are not physically in NC, please contact your local law enforcement agency (police department or sheriff’s office) to determine the closest location that provides fingerprinting services; not all agencies do, so please call ahead. Fingerprints must be done on the FD-258 card; please verify that the agency will be able to provide you with two (2) FD-258 fingerprint cards. If your chosen fingerprinting location cannot provide these cards, you may print them at home from this link.  Or, you may request that they be mailed to you from the NCBDN office at no cost, by emailing a request to: info@ncbdn.org.

Take these forms to your local law enforcement or fingerprinting agency as determined in Step 1. Fill out the two (2) fingerprinting FD-258 cards (mentioned in Step 1 above) using the instructions provided in the form downloaded in Step 2.  You must fill out all required fields, per the instructions. Fingerprinting must be performed by trained law enforcement personnel. Once you have completed the fingerprinting, please mail the signed Authority for Release of Information form, & the two (2) completed FD-258 fingerprint cards to:

Statutory Authority:

Per NC General Statute § 90-357.6, applicants (in-state and out-of-state) for LDN or LN licensure are required to undergo a fingerprint-based State Bureau of Investigation (SBI) and Federal Bureau of Investigation (FBI) criminal history check.

What if I know something is on my record?

If you have answered "yes" on the application indicating you have a pending charge, or prior conviction (misdemeanors and/or felonies that have not been expunged), please click here for supplemental documentation that will also be required.

What is Live Scan?

Live Scan is digital fingerprinting and transmission of the impression directly to the State Bureau of Investigation (SBI) and Federal Bureau of Investigation (FBI) for processing. If you reside in North Carolina, Live Scan can be used to obtain and transmit your digital fingerprints electronically to the State Bureau of Investigation (SBI) and Federal Bureau of Investigation (FBI). At this time, you cannot utilize LiveScan in any other states outside of NC.

Criminal Background Check Results

Please plan on results of the CBC taking 2 to 4 weeks from the time fingerprint cards are sent to SBI from our office. The NCBDN office will NOT have any update on your application during this time as the process is in the hands of the SBI. Once results are received by our office, we will process them as expeditiously as possible and you will receive an email from the system when your application has been approved. Please note, final results of your Criminal Background Check cannot be processed by this office until the signed and dated Electronic Fingerprint Submission Release of Information form (if in-state) or the Authority to Release Information form (if out-of-state) is received by the NCBDN office, AND you have paid all application fees.

Receipts

Receipts for all payments received are available in your licensee Gateway account by clicking on your pending application. Above the “Options” area there will be a blue “View Receipts” button.

Can I challenge the results of a Criminal History Record Check?

Yes, North Carolina allows an individual to review and challenge the results of a Criminal History Records Check. To do so, contact the agencies as listed below:

  • Visit the FBI's website for more information on obtaining your own report.
