NCBDN Lapsed License Procedure
The North Carolina Board of Dietetics/Nutrition voted at its meeting on October 20, 2010* to adopt the following procedural guideline. This procedural guideline is intended as a recommended protocol for the profession to follow. The guideline set forth below does not have the full force and effect of law, as would a North Carolina General Statute or a Board Rule. However, the Board uses procedural guidelines as an internal management tool in formulating decisions that relate to issues in the practice of human dietetics and nutrition.
Purpose: The purpose of this statement is to offer guidance to Licensees regarding the procedures for the reinstatement of lapsed licenses for LDNs.
Procedure:
I. An expired license shall lapse after the 31st day of May of the renewal year. If a Licensee does not renew his/her license by May 31st of the renewal year and did not apply for inactive status before March 31st of the renewal year, the Licensee’s last known employer on record with NCBDN will be sent a letter notifying the employer of the Licensee’s lapsed licensure status. A lapsed license may not be renewed or placed in inactive status. A lapsed license may be reinstated or relinquished.
If you choose to relinquish your license you must return your original certificate to the Board office, with a written statement indicating you are relinquishing your license. II. LAPSED BUT NOT PRACTICING
a. If an individual is not practicing dietetics/nutrition and has not practiced dietetics/nutrition in North Carolina since the individual’s license lapsed or is exempt from the licensure requirement and has been exempt since the individual’s license lapsed then the Board will reinstate the individual’s license upon the individual:
i. Completing the application for licensure and returning the original licensure certificate;
ii. Providing a notarized statement verifying that the Licensee was either not practicing dietetics/nutrition in North Carolina since the individual’s license expired or was exempt from the licensure requirements and has been exempt since the individual’s license lapsed (Download the Lapsed License Affidavit);
iii. Providing evidence of compliance with the cumulative continuing education/professional development requirements as specified in rule 21 NCAC 17.0109; and
iv. Paying the application ($50.00) and issuance fees ($125.00) for reinstatement of the individual’s license.
b. The license may not be reinstated until any cumulative deficiency is corrected or waived by the Board.
III. LAPSED AND PRACTICING BUT WITHIN THREE MONTHS OF LICENSE LAPSING
a. If an individual’s license is lapsed and this individual has been practicing dietetics/nutrition with a lapsed license, and seeks to reinstate his/her license within three months of the individual’s license lapsing (meaning, by August 31st of the year in which the individual’s license lapsed) the Board will reinstate the individual’s license upon the individual:
i. Completing the application for licensure and returning the original licensure certificate;
ii. Providing evidence of compliance with the cumulative continuing education/professional development requirements as specified in rule 21 NCAC 17.0109; and
iii. Paying the application fee ($50.00), and the issuance fee ($125.00) for reinstatement of the individual’s license.
b. A letter of reprimand will be sent to the individual and a copy of such letter will be kept on record in the individual’s file.
c. The license may not be reinstated until any cumulative deficiency is corrected or waived by the Board.
IV. LAPSED AND PRACTICING AND AFTER THREE MONTHS OF LICENSE LAPSING
a. If an individual’s license is lapsed and this individual has been practicing dietetics/nutrition with a lapsed license, and it is more than three months since the individual’s license lapsed (meaning, after August 31st of the year in which the individual’s license lapsed) this will be treated as a violation under 21 NCAC 17.0116 unless waived by the Board.
