The North Carolina Board of Dietetics is grateful to the over 1500 licensees who continue to support licensure by renewing their license and who work to protect the health, welfare and safety of the public by reporting unlicensed individuals. This fiscal yer we are celebrating the passage of Senate Bill 157, the successful completion of amended rules published in the North Carolina Administrative Code, and the continued efforts to strengthen communication with licensees and NCDA members through the NCDA Liaison, the website, The Link, and this newsletter. The Board welcomes your comments and suggestions for meeting these important goals and working hard to enhance the recognition of LDNs in North Carolina as the nutrition experts.


SUCCESS IN THE
LEGISLATURE!

   I would like to take the opportunity to thank all of the NCDA members who successfully lobbied for ht passage of the Senate Bill 157. The NCDA Board worked veryt hard to insure that legislators were personally contacted for support. Many thanks to Johnnie Jackson, RD, LDN, who serves as the NCDA Liaison the NCBDN Board, for her tireless work in coordinating the lobbying activities for dietitians from across the state.
   NCBDN has accomplished all of the goals set at the beginning of the 2000-2001 fiscal year. The law has been amended to insure that the needs of licensees are met both now ant in the future. The rules that govern the practice of dietetics set forth in Chapter 17 of the North Carolina Administrative Code have also been amended to more clearly support the law.
   In addition to law and rule changes, over 300 weight control programs have been reviewed and approved by the Board. There has been action taken against several weight control services that have violated the law. Most recently, there was an article in the Triangle Business Journal about the violation of the Dietetics Practice Act by Wade Harris, owner of Phase II Fitness. As a result of the litigation, Mr. Harris and persona trainers at Phase Ii Fitness have been ordered by the Office of the Attorney General to discontinue the provision of nutrition care services in all of their locations in the Triangle area. If you know of weight control programs that have not been reviewed, please contact the Board office.
   The Board is also continuing to update the website. The web address is www.ncbdn.org. Newsletters
    will be published on the web each quarter and licensee will also be able to access archived newsletters. In addition to newsletters, licensees will be able to access the law, most of the rules and some policies and procedures of the Board. There will be information on how to file a complaint with a link to the Compliance Investigator. Complaints may be filed online and sent directly to the Compliance Investigator for review.

License Renewal - 2001

   The licensure renewal period for 2001 is over. There have been several questions about the renewal fee, the late fee and the reinstatement fee. While the Board realizes that it may be difficult to keep abreast of all of the professional obligations that dietitians have, it is a government agency that must uphold the law governing the practice of dietetics. Below are the sections of the law and rules governing the renewal process.
       G.S. 90-362(c) states that licensees shall inform the Board of any changes of address.
G.S. 90-362(e) states that each licensee is responsible for renewing their license before the expiration date of March 31.
NCAC 21;17; .0109(c) states that a licensee's renewal application must be postmarked prior to the expiration date in

       order to avoid the late renewal fee. Failure to receive a renewal notice shall not be justification for late renewal.       

   All licenses expire on March 31 each year. A late fee of $50 plus the $50 renewal fee (a total of $100) must be paid between March 31 and May 31 each year to renew an expired license. After May 31, a license is considered lapsed. A $50 renewal fee, a $50 late fee and a $25 issuance fee ( a total of $125) must be paid after May 31 in 9order to reinstate a license. If a person chooses not to renew or reinstate a license. If a person chooses not to renew or reinstate a license, the licensure certificate must be returned to the Board office.
   The Board provides at least three notifications for licensure renewal . The first notice is in the fall issue of this newsletter. It is followed by a reminder notice in The Link. Finally, renewal notices are sent in January of each year, six weeks prior to the march 31 deadline.
   Please feel free to contact the Board office with any questions you may have regarding the renewal or reinstatement process. Attached is a list of those persons that did not renew their license. Do You Work with DTRs,
CDMs or Recent Grads?
   There have been several questions lately regarding the law and rules governing unlicensed persons aiding in the practice of dietetics. Most other questions asked have centered around the amount of supervision required for DTRs, CDMs, and recent graduates that have not yet passed the registration exam.
   Unlicensed personnel aiding in the practice of dietetics must work under the supervision of a LDN. According to the rules in the North Carolina Administrative Code, supervision means that a LDN shall be available for consultation on nutrition care services being performed by the unlicensed person being supervised. The supervising LDN must directly examine, evaluate, and approve the acts or functions of the unlicensed person.
   The supervising LDN and/or the facility where the nutrition care services rare performed decide and document the functions included in the scope of employment or contract of unlicensed persons
    providing nutrition care services, weight control services, and nutrition education. When considering what activities should be delegated to unlicensed persons and the amount of supervision necessary, it is important to review variables such as the knowledge and skills of the unlicensed person, the stability and acuity of the client's condition, and the established policies, procedures and channels of communication which lend support to nutrition care activities being provided by the unlicensed person.
   These rules will be published on the web site. However, if you would like a copy of the rules that govern the practice of unlicensed persons aiding in the practice of dietetics, please contact the Board office.

UPCOMING HOLIDAYS
   The Board office will be closed on September 3 for Labor Day. Please remember that the Board office is open from 9:00 a.m. until 4:00 p.m. Monday through Thrusday and from 9:00 a.m. until 3:00 p.m. on Fridays. The office is accessible through voice mail at all times and all phone calls received are returned by the end of the next working day.
