PROCESS OF REVIEWING A WEIGHT CONTROL PROGRAM OR SERVICE

ROLE OF THE NCBDN vs. THE REVIEWER

The North Carolina Board of Dietetics/Nutrition and the reviewer of the weight control program/service are independent parties. Each party has a unique and seperate role to play in reviewing weight control programs/services in North Carolina.

The reviewer's role is to provide an on-site evaluation of the weight control program to recommend approval or disapproval based on the program's compliance with the Act, Rules and Guidelines. The reviewer is responsible for submitting the Report with adequate supporting documentation and the necessary fees, on behalf of the weight control program, to the Board. The reviewer must also be available to the Board for any needed clarification regarding the Report.

The NCBDN's role is to implement and enforce the Act to Regulate the Practice of Dietetics/Nutrition, to adopt Rules that governing the that practice and that administer this law, and to provide the Guidelines for reviewing weight control programs/services. The Board provides a training and certification program to aid reviewers in following the Guidelines, in determing compliance with the Act and Rules and in assessing adherence with the standards. The Board maintains a list of Certified Reviewers which it makes available to weight control programs seeking a reviewer. The Board receives and reviews reports from reviewers and retains the right to disagree with the reviewer's recommendations based upon a lack of compliance with the Act and Rules. If the program is not approved, the Board advises the reviewer and the weight control program of the necessary course of action and time frames for achieving compliance. The Board verifies that the reviewer is a dietitian/nutritionist who is currently licensed and in good standing according to Article 25 Chapter 90 of the General Statutes and is currently enrolled in or has commpleted a Board-approved training program. The Board maintains files on all weight control programs reviewed and makes available copies of Reports on these programs to any party requesting such information. Upon receipt of a complaint concerning a person providing a weight control program or a reviewer, the board may investigate the situation to determine if the person is in violation of the Act or the Rules. Based upon the findings of the Investigator, the Board may institute action against the person.
